MEMORANDUM OPINION AND ORDER

George P. Mitchell brought this lawsuit against Zia Park, LLC (“Zia Park”) and Penn National Gaming, Inc. (“PNGI”) alleging that he was retaliated against and constructively discharged for statutorily protected conduct in violation of Title VII of the Civil Rights Act and the New Mexico Human Rights Act (“NMHRA”).
