This action arises from Plaintiff Richard Galvin’s investment of $299,000 into a gas well project located in Texas (hereinafter “the Project”) and headed, in part, by Defendant Spirit Energy, LLC (hereinafter “Spirit”), which Plaintiff alleges fraudulently induced him to invest in the Project. Plaintiff further alleges that Defendant Brian McCarthy, Chief Operating Officer of Spirit, defaulted on a promissory note (the “Note”) he executed in favor of Plaintiff to secure Plaintiffs investment in the Project.
