— The appellee, as plaintiff, sued the appellant, as defendant, in the court below, to recover damages for injuries sustained by appellee, from the alleged negligence of appellant.

In her complaint the appellee alleged, in substance, that the appellant was a' corporation, organized under “ An act' authorizing the construction of plank, macadamized, and gravel roads,” approved May 12th, 1852, and the amendments thereto, and as such was the owner of a gravel road leading from Brookville, in Franklin county, to Connersville, in Fayette county, Indiana, which was used and travelled as a public…
