Plaintiff Tony Phillips (“plaintiff’ or “Phillips”) has filed suit against his employer, the City of Allentown (“city” or “Allentown”) and its mayor, William Heydt (“mayor” or “Heydt”) (collectively “defendants”), alleging that the defendants violated his rights under the Civil Rights Act of 1964 (“Title VII”), 42 U.S.C. § 2000(e) et. seq., the Pennsylvania Human Relations Act (“PHRA”), 43 P.S. § 951 et seq., and 42 U.S.C. § 1981 (“Section 1981”).
