MEMORANDUM OPINION and ORDER

GIBSON, District Judge.

Perhaps correctly, this Court imagines that few current issues exist that so stir this country’s citizenry as the regulatory taking of private property. The anathema felt by certain citizens toward even the abstract concept of a regulatory taking is, perhaps, an inevitable outgrowth of this country’s particularized origin and history, born, as we were, from the promise of land available for private possession without molestation.
