SMITH, Chief Judge.

This case comes before the court on defendant’s Motion for Rehearing and/or to Dismiss. This motion follows the court’s denial of defendant’s original Motion to Dismiss, Mt. Sinai Medical Center, Inc. v. United States, 13 Cl.Ct. 561 (1987). The court granted defendant enlargements of time from November 20, 1987 through July 22, 1988 before the Motion for Rehearing was filed.
