In this appeal we consider whether the United States District Court for the Southern District of New York (William H. Pauley, III, Judge) plainly erred by sentencing defendant-appellant Hemenegildo Padilla Alvarado (“Padilla”) to, inter alia, a three-year term of supervised release even though Section 5Dl.l(c) of the United States Sentencing Guidelines (“U.S.S.G.” or “Guidelines”) provides that district courts “ordinarily should not impose a term of supervised release in a case in which ... the defendant is a deportable alien who likely will be deported after imprisonment.” U.S.S.G. §…
