Appeal from a judgment of the County Court of Schenectady County (Hoye, J.), rendered October 21, 2002, *690convicting defendant upon his plea of guilty of the crime of criminal sale of a controlled substance in the third degree.

In satisfaction of an 11-count indictment charging him with various drug-related crimes, defendant entered a negotiated plea of guilty to the crime of criminal sale of a controlled substance in the third degree and waived his right to appeal. Consistent with the plea agreement, County Court sentenced defendant as a second felony offender to 5V2 to 11 years in prison.…
