Appeal from a judgment of the County Court of Schenectady County (Gaetano, J.), rendered October 17, 2002, convicting defendant upon his plea of guilty of the crime of burglary in the second degree.

Defendant was charged in a 10-count indictment with various crimes as the result of an incident on December 29, 2001 when *742he entered a residence in the City and County of Schenectady and, among other things, assaulted his girlfriend’s uncle.
