This is a personal injury action for damages arising from a collision between plaintiff’s truck and defendant’s automobile on highway 54 about four miles east of Mexico. Plaintiff presented his case in the trial court on the humanitarian doctrine. Defendant counterclaimed on the ground that it was plaintiff’s negligence which caused the accident, and defendant’s resulting injuries. As to plaintiff’s case, at the close of all the evidence, the trial court sustained defendant’s motion for a directed verdict in favor of defendant and against plaintiff.
