The facts of this case are not disputed, and are thus stated in the brief of libelant’s counsel:

“In the month of January, 1801, the Reliance Lumber Co. of Beaumont, Texas, made application by mail to the defendant at Philadelphia, for certain marine insurance on the hark Ceres.
“The negotiations were finally consummated on February 7, 1901, when the defendant mailed at Philadelphia to the libelant at Beaumont, Texas, policy No. 7625 of the Commercial Insurance Co., and policy No. 0103 of the Lincoln Insurance Co., both insuring the libelant against marine risks…
