Appellee, Calvin Coombes, administrator of tbe estate of Ellen Coombes, bis deceased wife, brought an action in tbe Clay Circuit Court against tbe appellant, Public Savings Insurance Company of America, upon an industrial life insurance policy, issued upon tbe life of Ellen Coombes. An answer of general denial was filed to tbe complaint, with an agreement of tbe parties tbat all defenses might be offered under tbe same; trial by tbe court, judgment in favor of appellee, from which appellant appeals, and assigns as error the overruling of tbe motion for a new trial.
