This is an action in assumpsit brought to recover a balance claimed to be due for merchandise which it is alleged defendants agreed to purchase from plaintiff. A jury rendered a verdict in favor of the plaintiff for the full amount of the claim and a judgment ivas entered on the verdict. The defendants then appealed to this court alleging errors in the charge to the jury.

The plaintiff alleged in its statement of claim that defendants agreed to buy 50,000 machine bolts, and nuts from plaintiff by a written order, a copy of which was attached; that it was agreed verbally…
