In this original proceeding, two separate petitioners, Karen Morrissey (97SA3) and Richard Goggin, Walter Cross and Charles R. Duke (97SA5), challenge the constitutionality of Article XVIII, Section 12 (Amendment 12), a voter initiated amendment to the Colorado Constitution. 1 Pursuant to orders of this court issued on January 28, 1997, and March 31, 1997, these cases were consolidated and nine separate issues were set for briefing and oral argument. 2 We now hold that Amendment 12 is unconstitutional. '
