Plaintiff Metrokane, Inc. (“Metrokane”) filed the original Complaint in this action on February 13, 2001 against defendants The Wine Enthusiasts, Inc. (“TWE”), Adam Strum, Cybil Strum (collectively, the “Strums”) and Cisco Sales Corporation (“Cisco” or “defendant”), alleging, inter alia, copyright infringement, trade dress infringement and unfair competition.
