BOYD, Chief Justice.

This appeal arises from the denial of a pretrial application for -writ of habeas corpus in a murder prosecution. As we will recite in more detail later, it concerns a trial juror who, after having indicated affirmatively that she could consider the full range of punishment attached to the crime, after being sworn and empaneled as a member of the trial jury, and after an overnight break, recanted and admitted to the court and counsel that she could not consider the full range of punishment specified for the crime.
