Reversing.

Appellant operated a plant in Perry County, and on December 5, 1936, Anee Shepherd was killed while in its employ. Both parties had accepted the provisions of the Workmen’s Compensation Act, Kentucky Statutes, Section 4880 et seq., and an application for compensation under its provisions was duly filed by the statutory guardian of the decedent’s widow, the sole dependent. Thereafter the Board approved an agreement between the appellant and the guardian by which the widow was to receive $8.90 per week for 355 weeks. Payments were made aggregating…
