Richard Louis Von Nieda, defendant, was indicted on the charge of knowingly neglecting to perform a duty imposed upon him by the provisions of the Selective Service Act of 1948, as amended by the Universal Military Training and Service Act and the rules and regulations made pursuant thereto, in that he failed and refused to obey an order of Local Board Number 31, Reading, Pennsylvania, dated April 1, 1954, directing him to report to aforesaid Local Board for instructions concerning civilian work contributing to the maintenance of the national health, safety or interest,…
