OPINION

WILSON, Judge.

This case is before the Court on defendant’s motion to dismiss for failure to state a claim and on cross-motions for judgment on the administrative record. The major issue presented is whether government-imposed curfews and travel restrictions applicable to Japanese Americans during World War II deprived the plaintiff of liberty within the meaning of the Civil Liberties Act of 1988(CLA), 50 U.S.C. app. §§ 1989-1989d (1994).
