DONOHOE, District Judge.
The grand jury returned an indictment charging the defendant in some fifteen counts with violations of section 592, title 12 U.S.C.A. It appears from the charge of the indictment that at the times stated, the Bank of Paxton was a state bank, organized under the laws of the state of Nebraska, transacting a banking business, including the receiving of deposits; that at said times, the Bank of Paxton was an insured bank, duly insured by the Federal Deposit Insurance Corporation under the provisions of section 264, title 12 U.S.C.
