On September 11, 1939, this court, without written opinion, denied an application of the petitioner for a writ of habeas corpus to secure his release from the state penitentiary. On December 18, 1939, a writ of certiorari was granted by the United States Supreme Court. As the record on which this court acted, other than petitioner’s application, had not been formally presented, a motion for diminution was entertained for the purpose of securing an authentic transcript which could be certified for use in the certiorari proceeding.
