This action was brought by the appellant against the respondent banks to recover $4,057.50 paid on a series of checks drawn against appellant’s account in the Wells Fargo Bank, whereby appellant’s funds were misappropriated. Respondents recovered judgment for their costs.

M. R. Wallace was the Pacific Coast manager of the marine department of appellant, and had been since 1933. Its cashier and accountant was L. W. Bruntlett. Appellant in 1938, lodged with Wells Fargo Bank a copy of a resolution authorizing its checks to be signed by M. R. Wallace and countersigned by L. W. Bruntlett or J. F.…
