SWAIM, Circuit Judge.

This is an action under the Federal Employers’ Liability Act, 45 U.S.C.A. § 51 et seq., for injuries sustained by plaintiff, Otis P. Teets, an employee of the defendant, Chicago, South Shore and South Bend Railroad (hereinafter referred to as the Railroad).

The jury found the Railroad guilty of negligence, and assessed plaintiff’s damages at $8,500.00. The Railroad moved pursuant to Rule 50(b) of the Federal Rules of Civil Procedure, 28 U.S.C.A., to have the jury’s verdict, and the judgment entered thereon, set aside and to have judgment entered in accordance with its…
