This case is before the court on defendants’ Motion for Summary Judgment. The court DENIES defendants’ Motion.
BACKGROUND
Plaintiff Bernee Cargile brings this action pursuant to 29 U.S.C. § 1132 for wrongful failure to pay health and long term disability benefits. Plaintiff worked as an application assembly clerk for Confederation Life Insurance Company (Confederation Life). On November 14, 1986, plaintiff was involved in an automobile accident.
