Defendant-appellant Steven Vitale appeals from his conviction for theft (R.C. 2913.02) following a bench trial. This case arose out of a dispute over defendant’s failure to pay for car repairs which he claimed were not properly performed. Defendant argues that he was convicted on evidence that was not presented to the grand jury; that the state’s evidence was insufficient to prove the elements of theft; that his conviction was against the manifest weight of the evidence; and that the judgment of the trial court cannot stand because it is duplicitous, inconsistent and…
