This action was commenced in the district court of Oklahoma county, by the defendant in error. C. B. Whiteus, against the plaintiff in error, Prank Clark, for the recovery of damages for the wrongful conversion of a certain team of mules. The parties will be referred to here as they appeared in the trial court. This case was tried to the judge without the aid of a jury, and there was judgment for the plaintiff for $313, the reasonable value of the mules at the. time of their conversion.
