Thornton, J.:

This action was brought to compel the performance by defendant of a contract alleged to have been entered into by him with the plaintiff corporation.

It is alleged in the complaint, that some time in April, 1875, the plaintiff and defendant entered into two certain contracts for the sale of lands by the latter to the former; that in July, 1875, the parties above named entered into another contract for the sale of a tract of land by the defendant to the plaintiff; that in one of the tracts of land above referred to as agreed to be sold in April, 1875, one Tonner had an interest,…
