MEMORANDUM OPINION: FINDINGS OF FACT AND CONCLUSIONS OF LAW

This is an action for damages for breach of a collective bargaining agreement between the plaintiff Unions (both the Local Union and the International are plaintiffs; they will be referred to collectively as the “Union”) and the defendant Fibreboard. 1 The damages were suffered by 53 members of the Union employed by Fibreboard up to July 31, 1959 and terminated on that date when Fibreboard contracted out the maintenance operations at its Emeryville plants. 2 The claim in the- complaint rests on the…
