MEMORANDUM AND ORDER ON PLAINTIFFS’ MOTION F.R.C.P. 56 [Summary Judgment]

On May 2,1977, the Court made an Order denying plaintiffs’ Motion for Summary Judgment. Counsel then called the Court’s attention to the fact that there had been no action by the Court on the defendant’s second motion to dismiss the second amended complaint, which motion would, by stipulation, apply to plaintiffs’ third amended complaint.
