PICARD, District Judge.

The government brings this action under Section 4 of the Sherman Anti-Trust Act, Ch. 647, Sec. 4, 26 Stats. 209, 15 U.S.C.A. § 4, charging that defendants conspired to, and did, create a monopoly in the manufacture of concrete block making machines in violation of Sections 1 and 2 of the Act, 15 U.S.C.A. §§ 1, 2. Defendants are Besser Manufacturing Company and Stearns Manufacturing Company, Inc., producers of concrete block making machines, Jesse H. Besser, who owns 99 per cent of the Besser Manufacturing Company (hi-s wife 1 per cent) and Louis Gelbman and Hamlin F.…
