GARDNER, Chief Justice.
The appeal is from the decree overruling demurrer to the bill of complaint.
Complainant, seventy-nine years of age, whose wife is dead and who is without children, is the owner and in possession of 260 acres of land situated in Randolph county, which is particularly described in the bill. One Lela Joy Ownes when a small child, a niece of complainant’s wife, was taken into their home.
