GARDNER, Circuit Judge.
This was an action brought by appellant as plaintiff to recover damages for the alleged breach of an automobile liability policy of insurance issued by appellee to appellant on January 23, 1931, covering a sedan Dodge car, and insuring appellant against liability to an amount not exceeding $10,000 for bodily injury or death suffered or alleged to have been suffered by any person other than himself or those of his household, resulting directly from accident by reason of the ownership, maintenance, or use of the automobile.
