I. INTRODUCTION

This matter comes before the court on the parties’ cross-motions for summary judgment. The plaintiff, Lieutenant Commander (“LCDR”) Elizabeth Miller, is an active duty officer in the Judge Advocate General (“JAG”) Corps in the United States Navy. PL’s Compl. ¶ 3.
