The plaintiffs, Steven Trimmer, Eileen Philbin, and Craig Meyers1 brought this purported class action against the defendants, Barnes & Noble, Inc. and Barnes & Noble Booksellers, Inc. (collectively, “B & N”), alleging violations of the Fair Labor Standards Act (FLSA). The plaintiffs allege that they worked for B & N but were erroneously classified as being exempt from the overtime requirements of the FLSA and that they were not compensated for the overtime hours they worked.
