Defendant-appellant James Kukoa Aiu (hereinafter referred to as appellant) was convicted after a bench trial of the offense of Unauthorized Control of Propelled Vehicle. The trial court thereafter placed appellant on probation for a period of five years, with the added conditions that appellant ppend six months in Halawa Correctional Facility and that he make restitution for damages to the motor vehicle involved.
