We hold, in this appeal by Defendant-Appellant Christopher Keliiheleua (Defendant) in Cr. No. 02-1-2062, from an April 14, 2003 order of the circuit court of the first circuit 1 (the court), that the court did not err in denying Defendant’s motion to dismiss the charge of negligent injury in the first degree, Hawai'i Revised Statutes (HRS) § 707-705 (1993), 2 for preindictment delay (motion to dismiss).
