This matter is before the Court on the Report and Recommendation of the Magistrate Judge regarding Defendant Seneca Insurance Company, Inc.’s Motion (ECF DKT. # 63) for Partial Summary Judgment, to dismiss Plaintiff Corbo Properties, Ltd’s Second Cause of Action, i.e., Lack of Good Faith in denying Plaintiffs insurance claim.
