Affirming.
On the 9th day of December, 1916, the appellant, Tjiibe Martin, with a pistol, shot and mortally wounded •Outhrie Diuguid, in Curd street, in the town of Murray, ■ in Calloway county. The shooting took place at about •twelve o ’clock, on Saturday, and the wounded- man died on the following day, at about 4:30 p. m.
