Indictment against Matilda H. Chesbrough for violation of the customs duties law.

RELLSTAB, District Judge.

The indictment in this case is based on section 3082, Rev. St. U. S. (U. S. Comp. St. 1901, p. 2014). The *780demurrer is to- the first three counts. On the argument the United States abandoned the first and third counts. The demurrant alleges that the second count does not charge a crime.

Section 3082., which furnishes the basis for all the counts, reads as follows:.'“If any person shall fraudulently or knowingly import or bring into the United States,' or assist in so doing, any merchandise, contrary to law,. or shall receive, conceal, buy, sell, or in any manner…
