CLARK, Circuit Judge.

This is an appeal from a plaintiff’s judgment in an action for damages for breach of a contract for the sale of goods. Plaintiff, a New York corporation engaged in the lithographing business, contracted to sell to defendant Kamm Games, Incorporated, of Connecticut a quantity of novelty baseball games designed by the latter, to be manufactured on lithographed paper of certain specifications which are here in dispute. The second defendant, Raff, a Connecticut citizen, has been held as guarantor for the purchaser. The action is in the diversity jurisdiction of the court, and…
