Appeal by the defendant, Charles Bihler, from a judgment of the Court of General Sessions of the Peace in and for the county of New York, rendered against the defendant on the 28,th day of May, 1909, convicting him of the crime of libel.

Charles Bihler, the defendant, had been in the employ of Fenkart & Co., manufacturers of embroideries and laces, at St. Gall, Switzerland, from February, 1900, until the spring of 1901, when he was sent to their place of business in the city of New York, where he remained until February, 1906, when the relation of employer and employee between them ceased. He then became interested in another concern, but in December, 1906, returned to his former firm as manager of the New York office, remaining in such capacity until July 1, 1908.
