[1.] Did the indictment contain a sufficient averment of the publication of the libel % It charges that David Giles, the defendant, on the 6th day of July, 1847, did maliciously and falsely “ utter and publish, that is to say, did then and there write, and fasten upon the side of a tree in a public place, where it could *282be there read, the following malicious defamation, in writing, of and concerning one William Thompson (the prosecutor,) and others,” &c.
