Before the Court is a motion by the Defendant (a) to dismiss the above-captioned adversary proceeding complaint for failure to state a claim upon which relief can be granted, and (b) for summary judgment dismissing the complaint on the ground that there is no genuine issue as to any material fact and that he is entitled to judgment as a matter of law.
