The principal question for decision in this case, raised by motion for nonsuit at the trial, is upon the construction to be given to the language of a statute of this state, governing suits and actions against cities and other public corporations. The statute is § 5-502, Oregon Code 1930.
The plaintiff recovered a judgment against the city of Union for injuries sustained by him on September 24, 1936, as the result of the neglignce of the city in failing to keep one of its streets in a reasonably safe condition for ordinary travel.
