POOLER, District Judge.

INTRODUCTION

Presently before me are plaintiff Theodore Justice’s objections to a report-recommendation from Magistrate Judge Daniel Scanlon, Jr. The magistrate judge recommends that I deny plaintiffs motion for summary judgment and grant defendants’ cross-motion for summary judgment. I approve the report-recommendation in large part, but because I find Justice’s due process claim presents issues of fact, I deny summary judgment to both parties on that claim.
