Reversing.

G-. T. Railey instituted this action seeking to recover from the Citizens’ Insurance Company of New Jersey tlie sum of $1,000 on a fire insurance policy issued to Mm and covering a farm dwelling wMcli has been destroyed by fire.

Anticipating defenses that would probably be made, he alleged in Ms petition that he made no application, oral or written, for the insurance, nor did he make any representation or statement as. to his title to the property.
