This is an appeal from a judgment rendered March 27, 1939, in the district court of Logan county, in favor of J. E. Marshall, plaintiff below, for personal injuries sustained in an automobile collision, against Fairmont Creamery Company and Roy Henness, defendants below. For convenience the parties will be referred to as they appeared in the trial court.
