MEMORANDUM AND ORDER
SEYBERT, District Judge:
Pending before the Court is Defendant’s motion and Plaintiffs cross-motion for summary judgment. For the reasons that follow, the Court GRANTS Defendant’s motion in part and DENIES Plaintiffs motion in its entirety.
