In this case, the defendant was required by the judgment of the court below “forthwith to execute and deliver to plaintiff a note and mortgage, to wit, her promissory note in the sum of $1,662.40, payable to plaintiff on demand, and bearing interest at the rate of seven per cent per annum from the fourth day of October, 1882, secured by her mortgage on the lands and premises described in plaintiff’s amended complaint, the same being a certain lot of land and premises situate, lying, and being in the township of Mcasio, county of Marin, state of California”; and from the judgment, and an order…
