The defendant was indicted as an accessory after the fact to the crime, alleged to have been committed by Evelyn Dawn, of unlawfully using an instrument on the body of a woman with intent to procure a miscarriage, in consequence of which the woman died. G. L. (Ter. Ed.) c. 274, § 4; c. 272, § 19. The defendant waived a trial by jury and his case was tried before a judge of the Superior Court with the case against Evelyn Dawn.
